Marriage Registration

Marriage Registration is one of the most important but most neglected aspect of a wedding in India.  In rural india, even today most of the people do not know wheather marriage registration process exist in India.  And if some of them know about it they do not know how to get a marriage registered and whom should they approach for getting their marriage registered.

Even people in urban India tend to neglect marriage registration and does not give it due importance.  But now Government of India has made it  mandatory for everyone to get their marrige registered.

A Certificate of Marriage provides proof of marriage, social security and is useful in obtaining passport, visas for spouses to travel together.  It becomes more important if any of the partner is changing his or her name or surname (maiden name) after marriage, which is very much in practice in India for the brides to change their surname after marriage.  At times people need to prove that they are legally married to someone and there a need for certificate of marriage arises.

Process for marriage registration is a bit different for “Marriage Registration under The Hindu Marriage Act” and “Marriage Registration under the Special Marriage Act”.

Marriage Registration Act

A marriage which has already been solemnised can be registered either under the Hindu Marriage Act, 1955 or under the Special Marriage Act, 1954. The Hindu Marriage Act is applicable in cases where both husband and wife are Hindus, Buddhists, Jains or Sikhs or where they have converted into any of these religions. Where either of the husband or wife or both are not Hindus, Buddhists, Jains or Sikhs the marriage is registered under the Special Marriage Act, 1954.

Further, marriage can be solemnised between any two persons under the provisions of the Special Marriage Act, 1954.
